Cutter Law P.C.

Imagine you are driving down the freeway in Sacramento. There are lots of cars around you and people are travelling at high speeds, changing lanes and merging. Now imagine closing your eyes, taking your hands off the wheel and completely ignoring everything around you while you drive the length of a football field.

Reasonable drivers would never do something like this, would they? Sadly, they would and they do whenever they use their cellphones while driving. Driver distraction due to cellphone use is a very serious problem in California, and too many people fail to take seriously the danger in which they put themselves and others when they use a phone while driving.

Using a phone while driving is distracting in three different ways, as explained by the Centers for Disease Control and Prevention.

  1. It is visually distracting, as your eyes are on your phone and not the road.
  2. It is cognitively distracting, as you are paying attention to what you are doing on your phone.
  3. It is manually distracting, as your hands are holding the phone or typing on it.

If you are distracted in these ways, you aren't able to swerve, apply the brakes or do anything else to avoid a collision. When a driver does not make any accident-avoidance maneuvers, a resulting crash can be at full speed and direct.

With all this in mind, readers should understand that distracted driving is dangerous driving, and cellphone use while driving is among the most distracting behaviors there is.

People who text, update social media, video chat and/or take pictures while they are driving are putting themselves and every motorist around them in serious danger. If you have been injured in an accident with a distracted driver, you should not have to pay the price for his or her negligence. You can work with an attorney to file a personal injury claim and pursue compensation you may deserve.
